Following a jury trial, defendant was convicted of three counts of knowing that she tested seropositive for HIV and engaging in sexual penetration without informing her partner that she was HIV infected, MCL 333.5210; MSA 14.15(5210). Thereafter, the trial court sentenced defendant to concurrent terms of two years and eight months to four years imprisonment for each of the three counts. On appeal, this Court affirmed her convictions. People v Jensen, 222 Mich App 575; 564 NW2d 192 (1997). Defendant filed her application for leave to appeal with the Supreme Court. Pursuant to MCR 7.302(F)(1) and in lieu of granting leave, the Supreme Court ordered:
