(1) Brandywine Transmission Service, Inc. ("BTS") appeals from a decision of the Superior Court that granted the appellees motion for summary judgment. The trial court found no merit in BTS claim that the appellees alteration of the highway facing BTS property had effected a governmental taking for which compensation must be paid. On appeal, BTS contends that summary judgment was inappropriate because the factual basis for its claim was in dispute.
